Bearsec Prophecies – “Aggravated Harrasment”

O_RLY__Y_SO_SRS__by_AreyuI woke up in the middle of the night a couple of days ago.  I was not able to fall back to sleep so I decided I would check in on the goons I’ve been observing for the past month or so.  I spoke in local to see if anyone was awake because I was bored and there was no one on d-scan.  One of the residents was awake, and he proceeded to explain to me why AFK cloaking is a bannable offense, a crime, and could lead to a civil cause of action… At first I did not really understand what he was saying but fortunately for me he was both a lawyer and a police officer and willing to explain these complicated things to me…

The log of the conversation follows:

[ 2014.10.09 06:59:21 ] Dr Farallon > Well I hope they fix the whole AFK cloaking thing first honestly, but after that yeah it would be cool.
[ 2014.10.09 06:59:59 ] Rajen Andven > I thought the whole AFK cloaking thing was working as intended per CCP
[ 2014.10.09 07:00:23 ] Rajen Andven > They should probably remove local.  That should fix any AFK cloaking issues I think.
[ 2014.10.09 07:00:42 ] Dr Farallon > It’s more the AFK bit they don’t like.
[ 2014.10.09 07:00:51 ] Dr Farallon > Takes system resources… that’s against the EULA
[ 2014.10.09 07:01:38 ] Dr Farallon > I don’t care if you cloak and observe. That’s cool. But going afk for long periods of time is actually agains the TOS.
[ 2014.10.09 07:02:01 ] Rajen Andven > Yeah, no one should do that
[ 2014.10.09 07:02:06 ] Rajen Andven > Like AFKing while docked
[ 2014.10.09 07:02:17 ] Rajen Andven > That should be a bannable offense I think.
[ 2014.10.09 07:02:43 ] Dr Farallon > The difference being that you need to prove a legitimate reason for being in the system and afk. Docked up is actually okay with CCP. Cloaking camping isn’t, or so they say.
[ 2014.10.09 07:03:07 ] Dr Farallon > I haven’t had a chance to really get into it, but I’ve been talking with them the last few days to try and build a case – even a real criminal case – against cloaking campers.
[ 2014.10.09 07:03:12 ] Rajen Andven > That’s an interesting take on things.  Seems to not be a resource based argument.
[ 2014.10.09 07:03:14 ] Dr Farallon > It’s called aggravated harassment.
[ 2014.10.09 07:03:30 ] Rajen Andven > Ah…are you some kind of lawyer or something?
[ 2014.10.09 07:03:55 ] Dr Farallon > I’m both a lawyer and a police officer actually. Kinda neat. I like projects like this.
[ 2014.10.09 07:04:21 ] Rajen Andven > Ohhh interesting.  What area of the law do you practice and what jurisdiction?
[ 2014.10.09 07:04:29 ] Dr Farallon > When CCP reps come to Comic Con in NYC tomorrow and through the weekend I get to meet them and discuss this issue.
[ 2014.10.09 07:04:44 ] Rajen Andven > This issue of people cloaking in your system?
[ 2014.10.09 07:04:57 ] Dr Farallon > In any system – and it has to be AFK cloaking.
[ 2014.10.09 07:05:16 ] Dr Farallon > Cloaking itself is fine. Cloaking and then going out to lunch isn’t.
[ 2014.10.09 07:05:19 ] Rajen Andven > Seems like an issue of legitimate law enforcement concern.
[ 2014.10.09 07:05:30 ] Rajen Andven > Are you pursuing any criminal cases against AFK dockers?
[ 2014.10.09 07:05:36 ] Dr Farallon > Either log off and don’t deprive the players who are indigenous to the system of limited server resources, or play.
[ 2014.10.09 07:05:38 ] Rajen Andven > Those are what really get me riled up, tbh.
[ 2014.10.09 07:06:13 ] Dr Farallon > It’s criminal charges. An A class misd. No jail time, but you’d have to see a judge.
[ 2014.10.09 07:06:27 ] Dr Farallon > You couldn’t get on a plane or go overseas until you settled it.
[ 2014.10.09 07:06:45 ] Rajen Andven > Oh I see.  So the AFK docker would potentially have a hold that would show up on his NCICs?
[ 2014.10.09 07:06:48 ] Dr Farallon > CCP has a policy of not giving out player information unless its for criminal cases, and that’s what I’m intending on proving.
[ 2014.10.09 07:07:08 ] Rajen Andven > I’m sorry, I meant the AFK cloaker, not docker.
[ 2014.10.09 07:07:48 ] Dr Farallon > Yep. Harassment by electronic means. “To intentionally and knowingly alarm or annoy another…”
[ 2014.10.09 07:08:09 ] Rajen Andven > That sounds like something affecting interstate commerce, maybe you should go federal with it.  New York State is too small for a problem this big.
[ 2014.10.09 07:08:53 ] Dr Farallon > Baby steps. It would get piggy backed on all the anti-bullying legislation. At least that’s the plan.
[ 2014.10.09 07:09:42 ] Rajen Andven > I see. Is it going to be just AFK cloaking or is AFK docking, trading, and mining going to be in there? I feel harrased when people AFK next to me.
[ 2014.10.09 07:10:10 ] Dr Farallon > Nah… because you gotta prove the waste of system resources thing. It’s about intent.
[ 2014.10.09 07:10:29 ] Rajen Andven > Miners are a waste of resources by definition, am I right?
[ 2014.10.09 07:10:32 ] Dr Farallon > Docking is, by it’s nature, meant to be a safe haven for people.
[ 2014.10.09 07:10:51 ] Nori Galathil > Rajen Andven lol
[ 2014.10.09 07:10:58 ] Dr Farallon > Actually they are a collector of resources by their definition.
[ 2014.10.09 07:11:10 ] Nori Galathil > what made your ship a miner
[ 2014.10.09 07:11:34 ] Dr Farallon > The use of system resources is to be expected. That’s why we pay to play the game.
[ 2014.10.09 07:11:47 ] Rajen Andven > Collector of resources? You mean like tears? I thought miners produced tears, not collected them.
[ 2014.10.09 07:12:04 ] Dr Farallon > It’s the person who AKF cloaks and intentionally annoys or alarms other players while serving no legitimate purpose who is violating the spirit of the game.
[ 2014.10.09 07:12:05 ] Rajen Andven > This game is so confusing for me some times.
[ 2014.10.09 07:12:29 ] Dr Farallon > Obviously you’re not taking this seriously any more.
[ 2014.10.09 07:12:34 ] Rajen Andven > I’m glad to have a lawyer here to explain things to me though.
[ 2014.10.09 07:12:56 ] Rajen Andven > No no, I’m taking it seriously, I just don’t really understand this laws thing. You know?
[ 2014.10.09 07:13:28 ] Dr Farallon > I think I’ve explained it enough. You’re free to scroll up and re-read if needed.
[ 2014.10.09 07:13:35 ] Nori Galathil > Rajen Andven your slow stop being slow
[ 2014.10.09 07:13:42 ] Rajen Andven > Sorry :\
[ 2014.10.09 07:13:54 ] Dr Farallon > We’ll see how it goes this weekend.
[ 2014.10.09 07:14:24 ] Rajen Andven > Why only a misdeanor? Aggravated harrassment sounds to me like it should be a felony…you know like agg stalking, or agg assault, or some other term I heard on tv the other day.
[ 2014.10.09 07:14:33 ] Rajen Andven > misdemeanor*
[ 2014.10.09 07:15:23 ] Dr Farallon > Because that’s the law, or at least the local law here. If it gets any traction we’ll see. Think of the charge as a stepping stone to greater things.
[ 2014.10.09 07:15:56 ] Dr Farallon > Very rarely do I only charge Agg Harassment to a perp. It’s more a gateway charge.
[ 2014.10.09 07:16:17 ] Dr Farallon > Or it’ll open up a civil suit for damages, which sometimes is in the better interest of justice.
[ 2014.10.09 07:16:23 ] Rajen Andven > I see.  It sounds promising.  We can only hope for a world where people can feel safe not just in the real world but also in a virtual world.
[ 2014.10.09 07:16:44 ] Dr Farallon > No… we don’t want safety. Just fair play.
[ 2014.10.09 07:17:12 ] Rajen Andven > A world where all races are created equal.  Where Amarrians, Minmatarians, the Gallente, and the Caldari can all come together as one, in harmony.
[ 2014.10.09 07:17:21 ] Dr Farallon > I don’t care if you attack me. That’s the game. I care when anyone can sit in a system for days on end with no possible recourse.
[ 2014.10.09 07:17:27 ] Rajen Andven > Such a world would indeed be wonderful.
[ 2014.10.09 07:17:50 ] Dr Farallon > I suppose so. But null sec will always be null sec.
[ 2014.10.09 07:18:09 ] Dr Farallon > Anyway, I’m off to bed.
[ 2014.10.09 07:18:24 ] Dr Farallon > I’m sure I’ll see you in the morning. I’m kinda counting on it actually. See ya around!
